Constitutional Foundation

Article 30(1) of the Constitution of India

“All minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.”

Article 30 is a fundamental right enshrined in Part III of the Constitution. Unlike other regulatory provisions, the right under Article 30(1) cannot be curtailed by ordinary state legislation or circulars. It affords minority institutions full autonomy over management, staff appointment, curriculum design within board parameters, and institutional vision.

Landmark Judicial Precedents

T.M.A. Pai Foundation v. State of Karnataka

Established that minority institutions have the autonomy to administer their schools, including the right to determine fee structures, appoint principals, and formulate their own governing bodies.

5-Judge Bench (2014)

Pramati Educational Trust v. Union of India

Held that the Right to Education (RTE) Act’s 25% mandatory quota for disadvantaged sections does not apply to aided or unaided minority institutions, preserving Article 30(1) autonomy.

7-Judge Bench (2005)
